Platesfull Terms and Conditions

1. Introduction

These Website Terms and Conditions ("Terms") constitute a legally binding agreement between you and Platesfull, LLC ("Platesfull," "we," "us," or "our"). These Terms govern your access to and use of our website at www.platesfull.com and our mobile application (collectively, the "Platform").

These Terms apply differently to three categories of individuals:

  • 1. Visitors: Individuals who browse the Platform without creating an account.
  • 2. Clients: Registered users who use the Platform to book cooking services.
  • 3. Chefs/Cook Genies: Registered users who provide cooking services through the Platform.

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not access, use, or otherwise sign up for this Platform.

2. Visitors

2.1 Limited License

Visitors are granted a limited, non-exclusive, non-transferable license to access and view the public portions of the Platform for personal, non-commercial purposes.

2.2 Restrictions
Visitors may not:
  • a: Create an account or book services
  • b: Access non-public areas of the Platform
  • c: Scrape, copy, or reproduce any content from the Platform
  • d: Use the Platform for any commercial purpose
2.3 Lawful Use

You may use our Website and App only for lawful purposes. You must not use our Website or App in any way that breaches any applicable local, national, or international law or regulation, or in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.

You must not use or attempt to use any automated program (including, without limitation, any spider or other web crawler) to access our system, our Website, or the App.

You must not use any scraping technology on our Website.

You must not misuse our Website or App by:

  • - knowingly introducing viruses, trojans, worms, logic bombs, time bombs, keystroke loggers, spyware, adware, or other material, program, or code which adversely affects the operation of any computer software or hardware (or is designed to do so)
  • - gaining or attempting to gain unauthorized access to the server on which our Website or our App are stored or any server, computer, or database connected to our Website or App
  • - attacking our Website or App via a denial-of-service attack or a distributed denial of-service attack

3. Clients

3.1 Account Creation

To become a Client, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Booking Services

In order for Clients to book services through the Platform they MUST AGRE to these Terms and any additional booking terms presented at the time of booking.

3.3 Driver's License Verification

Clients agree to provide a valid driver's license or government-issued ID for verification purposes. This information will be shared with the hired Chef for safety reasons. By using our services, you consent to this sharing of information.

3.4 Home Environment

Clients are responsible for ensuring their home environment is safe and suitable for the Chef to provide services. Chefs may decline service if they have reasonable safety concerns about a Client's home or situation.

3.5 Refunds

Refunds for cancelled or unsatisfactory services will be processed according to our Refund Policy, which is incorporated by reference into these Terms. Refunds outside the normal website process may be handled manually by Platesfull at its discretion.

3.6 Miscellaneous Charges

There may occasionally be unforeseen expenses by the Chef or Cook Genie that are related to the services rendered to the Client. In such cases, those charges will be added to the Client bill.

Examples of those expenses may include traveling costs, parking fees, etc

3.7 Marketing

During their term of employ by the Client, Chefs and Cooks are permitted to record videos and/or take pictures within the Client’s home of the services rendered, which videos and pictures may be used for marketing/branding for PlatesFull, LLC. These pictures and videos will be taken in a way that reasonably protects the Client’s privacy.

Any pictures or videos of services rendered that are taken within a Client’s home, while the Chef or Cook is operating as an Independent Contractor of PlatesFull, are the sole property of Platesfull, LLC, and may only be used to promote that brand.

4. Chefs, Cook Genies, Party Helpers & Partners

For purposes of this Agreement, Chefs, Cook Genies, and Party Helpers may collectively be referred to as “Contractors,” unless otherwise specified.

4.1 Independent Contractor Status

Chefs, Cook Genies, and Party Helpers (“Contractors”) are independent contractors and not employees, agents, or representatives of Platesfull. Contractors are solely responsible for their own taxes, insurance, permits, certifications, and compliance with all applicable federal, state, and local laws and regulations. Contractors may not assign or transfer any of their rights or obligations under this Agreement without prior written consent from Platesfull.

4.2 Scope of Services

Chefs are culinary professionals who may provide services including menu planning, grocery procurement, cooking, serving, and post-event cleanup.

Cook Genies are self-taught or non-formally trained cooks who may provide similar in-home cooking and event services.

Party Helpers provide non-culinary support services only, which may include event setup assistance, kitchen and dining area organization, guest greeting, beverage service (non-alcoholic unless otherwise certified), and cleanup services, depending on the selected package.

Party Helpers do not provide cooking, menu planning, or food preparation services unless explicitly stated and agreed upon through the Platform.

4.3 Right to Decline Service

Contractors may decline service if they have reasonable safety, legal, or other concerns related to a Client’s home, environment, or situation. Contractors must document and provide supporting information for declining service through the Platform’s reporting system or as otherwise directed by Platesfull.

4.4 Client Information & Confidentiality

Contractors may receive limited Client information, including verified identification details, solely for safety and service fulfillment purposes. Contractors agree to keep all Client information strictly confidential and to use such information only in connection with services rendered through the Platform.

4.5 Services Rendered via Platesfull ONLY (Non-Circumvention)

Once a Contractor has been introduced to a Client through the Platesfull Platform (web or app), all services between the Contractor and the Client must be conducted exclusively through the Platesfull Platform. While engaged with Platesfull, and for a period of twelve (12) months following termination of the relationship, Contractors may not provide services to any Client independently or outside of the Platesfull Platform.

4.6 Removal of Independent Contractors

Platesfull reserves the right, at its sole discretion, to suspend or terminate a Contractor’s access to the Platform and discontinue the relationship at any time. Reasons for removal may include, but are not limited to: poor performance, Client complaints, violations of platform policies, safety concerns, unprofessional conduct, or failure to comply with this Agreement.

4.7 Business Name, Logo, and Social Media Usage

Platesfull reserves the right to restrict the use of any business logos, business names, and/or social media links associated with Chefs, Cook Genies, and other contractors on the Platesfull website. This may include, but is not limited to, the display of such materials on user profiles, listings, or other platform pages, at Platesfull's discretion.

This policy ensures consistency and brand alignment across the platform. Platesfull may request the removal or modification of any business identifiers that do not meet platform standards or are deemed inappropriate.

4.8 Pricing and Rate Recommendations

Platesfull may provide pricing guidance or rate recommendations to Contractors based on experience, skill level, market conditions, and service type. Contractors retain sole responsibility for setting their final rates and pricing structures.

4.9 Non-Circumvention & Marketplace Exclusivity

By using the Platform, all Contractors, Partners, and Influencers agree to conduct all related transactions exclusively through the Platesfull marketplace. Any attempt to bypass the Platform, including forming independent agreements, collaborating on events, or engaging in off-platform financial arrangements related to services offered through Platesfull, is strictly prohibited. Violations may result in suspension or termination of platform access and may subject the violator to legal action.

4.10 Damage Reporting Window (All Contractors)

Any claims related to property damage allegedly caused by a Chef, Cook Genie, Party Helper, or other independent contractor must be reported to Platesfull within forty-eight (48) hours of the completion of the service. Clients must provide reasonable supporting documentation, including photographs, written descriptions, and any additional information reasonably requested by Platesfull. Failure to report alleged damages within this timeframe may result in the claim being deemed invalid and no further action being taken.

4.11 Unsafe Environment & Right to Terminate Services

All Contractors reserve the right to decline, pause, or terminate services immediately if they reasonably determine that the Client’s location, environment, or event conditions are unsafe, unlawful, hostile, or otherwise unsuitable.

This includes, but is not limited to:

1. Threatening, abusive, or inappropriate behavior by the Client or guests

2. Illegal activity or requests

3. Excessive intoxication or disorderly conduct

4. Unsanitary, hazardous, or unsafe working conditions

5. Presence of weapons, dangerous animals, or undisclosed hazards

In such circumstances:

1. The Contractor may leave the premises without penalty

2. Platesfull shall not be liable for incomplete or disrupted services

3. No refunds will be issued for services already rendered

Platesfull reserves the right to review the incident and take appropriate action, including suspension or termination of the Client’s or Contractor’s access to the Platform.

4.12 Party Helper Services & Limitation of Liability

Party Helpers provide non-culinary, non-professional event assistance services only, which may include setup assistance, kitchen and dining area organization, guest greeting, non-alcoholic beverage service, and post-event cleanup, depending on the selected service package.

Party Helpers do not provide cooking, food preparation, menu planning, childcare, security services, or professional event management unless explicitly stated and booked through the Platform.

Clients acknowledge and agree that:

1. Food & Beverage Responsibility - All food and beverages are provided by the Client or third-party vendors. Party Helpers are not responsible for food quality, food safety, allergens, dietary compliance, or food-related illnesses.

2. Alcohol Service Disclaimer - Party Helpers do not serve, pour, or manage alcoholic beverages unless they possess required certifications and such service is explicitly approved and booked through the Platform. Platesfull does not assume responsibility for alcohol-related incidents.

3. Property & Valuables - Clients are responsible for securing personal property, valuables, pets, and sensitive items prior to the event. Platesfull and Party Helpers are not responsible for loss or damage to personal belongings unless caused by proven gross negligence or willful misconduct.

4. No Childcare or Supervision Duties - Party Helpers do not provide childcare, supervision of minors, or guest monitoring services. Clients remain fully responsible for the safety and supervision of their guests, including children.

5. Assumption of Risk - Clients acknowledge that hosting an in-home event carries inherent risks, including but not limited to spills, minor property damage, or accidents, and agree to assume responsibility for such risks except where prohibited by law.

6. Limitation of Liability - To the fullest extent permitted by law, Platesfull shall not be liable for indirect, incidental, special, or consequential damages arising from Party Helper services. Any liability shall be limited to the amount paid for the specific Party Helper service booked through the Platform.

4.13 Third-Party Partners & External Service Providers

From time to time, Platesfull may introduce or provide Clients with contact information, website links, or references to third-party service providers (“Partners”), including but not limited to magicians, nannies, photographers, musicians, party decorators, entertainers, or other event-related professionals.

Platesfull’s role with respect to such Partners is limited solely to making introductions or referrals. Platesfull does not employ, manage, supervise, endorse, or guarantee the quality, availability, pricing, safety, legality, or performance of any Partner’s services.

Clients acknowledge and agree that:

Independent Relationship - Any engagement, agreement, or transaction between a Client and a Partner occurs directly and independently between those parties. Platesfull is not a party to such agreements and bears no responsibility for their execution.

2. Client Due Diligence - Clients are solely responsible for conducting their own due diligence, including verifying credentials, licenses, insurance, certifications, references, and suitability of the Partner for their specific needs.

3. No Liability for Partner Services - Platesfull shall not be liable for any acts, omissions, negligence, misconduct, delays, cancellations, damages, losses, injuries, or disputes arising out of or related to services provided by Partners.

4. No Guarantees or Warranties - Any information provided about Partners, including contact details or website links, is offered for convenience only and without warranties of any kind, express or implied.

5. Dispute Resolution - Any disputes, claims, or issues arising between a Client and a Partner must be resolved directly between those parties. Platesfull is not obligated to mediate, arbitrate, or otherwise intervene.

6. No Platform Coverage - Services provided by Partners are not covered under Platesfull’s insurance, guarantees, or service protections, unless explicitly stated in writing.

5. Cancellations & Rescheduling

5.1 Cancellation Policy

Cancellation of a booking will incur charges as per below policy-

  • - Cancellations made beyond 168 hours (7 days) prior to the event will incur a fee of 10% on the booking amount.
  • - Cancellations made between 120 hours (5 days) to 168 hours (7 days) prior to the event will incur a fee of 50% on the booking amount and any actuals incurred by Chef for groceries or other purchases.
  • - Cancellations made less than 120 hours (5 days) prior to the event: No refund; and actuals incurred by Chef for groceries or other purchases for the task need to be paid by the client.
5.2 Rescheduling Policy

Clients may reschedule their service by requesting the chef to update the schedule. It is in Chef’s discretion to accept/reject the reschedule request. Incase reschedule is not accepted by the Chef, then the cancellation policy rules will be applicable.

6. “Split the Bill” Terms & Conditions

By using the "Split the Bill" feature on our platform, you (“Organizer”) and your invited participants (“Guests”) agree to the following terms and conditions:

6.1 Consent to Share Personal Information
  • - The Organizer may provide the names and email addresses of Guests solely for the purpose of splitting the total booking cost.
  • - By submitting a Guest's information, the Organizer confirms they have obtained the Guest’s consent to share their information with Platesfull.
  • - Guests will receive an email with details of the booking, the amount owed, and a secure link to make payment.
6.2 Use of Guest Information
  • - Guest information will only be used to facilitate payment and communicate relevant booking information.
  • - Platesfull will not share Guest information with third parties or use it for marketing purposes unless consent is explicitly provided.
  • - All personal data will be handled in accordance with our Privacy Policy.
6.3 Payment Agreement
  • - Guests are responsible for submitting payment for their portion of the total booking within the timeframe provided in the email notification.
  • - Failure to make timely payment may result in the Organizer being charged the full amount.
  • - Platesfull is not liable for any disputes between Organizers and Guests related to payment responsibilities.
6.4 Booking Confirmation
  • - A booking will only be confirmed once the total payment amount is received.
  • - The Organizer remains the primary point of contact and is ultimately responsible for ensuring full payment is completed.
6.5 Cancellations and Refunds
  • - All cancellations and refund requests are subject to Platesfull’s standard Cancellation Policy, which applies to the entire booking amount regardless of how it is split.
  • - In the event of a refund, individual Guest payments will be returned to the original method of payment where possible.

7. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Platesfull or its licensors and is protected by copyright and other intellectual property laws.

As referenced in section 3.6 of this Agreement, any pictures or videos of services rendered that are taken within a Client’s home, while the Chef or Cook is operating as an Independent Contractors of PlatesFull, are the sole property of PlatesFull, LLC, and may only be used to promote that brand.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLATESFULL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • a: YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM;
  • b: ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM, INCLUDING WITHOUT LIMITATION ANY SERVICES PERFORMED BY A CHEF OR COOK GENIE;
  • c: ANY CONDUCT OR CONTENT OF ANY CLIENT ON THE PLATFORM, INCLUDING WITHOUT LIMITATION, PRIOR TO, DURING THE PERFORMANCE OF, AND FOLLOWING THE SERVICES PERFORMED BY A CHEF OR COOK GENIE FOR SUCH CLIENT;
  • d: ANY CONTENT OBTAINED FROM THE PLATFORM OR THROUGH A CHEF/COOK GENIE/CLIENT’S USE OF SUCH CONTENT OBTAINED PRIOR TO, DURING THE PERFORMANCE OF, AND/OR FOLLOWING THE SERVICES PERFORMED BY A CHEF OR COOK GENIE FOR SUCH CLIENT; OR
  • e: UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR INCLUDING ANY CHEF’S/COOK GENIE’S/CLIENT’S TRANSMISSIONS OR CONTENT.

9. Arbitration Agreement

9.1 Agreement to Arbitrate

You and Platesfull agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

9.2 Arbitration Procedures

The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes then in effect. The arbitration will be conducted in Austin, Texas, and any arbitrator(s) selected must be willing to virtually conduct any arbitration proceedings, unless you and PlatesFull agree otherwise.

9.3 Class Action Waiver

YOU AND PLATESFULL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
